Terms of Service

These Terms of Service ("Terms") govern the relationship between GameServersHub LLC ("GameServersHub," "GSH," "we," "us," or "our") and any individual or entity ("Customer," "User," or "you") that accesses or uses our websites, control panels, APIs, Discord bots, hosting services, dedicated machines, or any related products or services (collectively, the "Services").

By creating an account, purchasing, accessing, or using any Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our Services.


1. Eligibility

You may only use the Services if:

  • You are at least 18 years old, or have verifiable consent from a parent or legal guardian;
  • You are legally capable of entering into a binding contract;
  • You are not prohibited from receiving services under United States law;
  • Your account has not been previously suspended or terminated for violations of these Terms.

We reserve the right to refuse service to anyone at our sole discretion.


2. Services Covered

These Terms apply to all offerings, including but not limited to:

  • Game server hosting
  • Discord bot hosting and SaaS-style bot services
  • VPS and cloud services
  • Dedicated machines and bare-metal servers
  • APIs, dashboards, automation tools, and integrations

Service-specific rules may apply and are incorporated by reference.


3. Account Responsibility & Security

You are responsible for:

  • Maintaining accurate account information
  • Securing all credentials, API keys, and tokens
  • All activity conducted under your account

You must not share, sell, transfer, or allow unauthorized access to your account. We are not liable for losses resulting from compromised credentials.


4. Acceptable Use & Abuse

You may not use the Services to:

  • Violate any applicable law or regulation (local, state, federal, or international)
  • Host, distribute, or facilitate malware, exploits, phishing, pirated content, or illegal material
  • Launch, participate in, or facilitate DDoS/DoS attacks or network abuse
  • Circumvent system limitations, safeguards, or billing controls
  • Abuse CPU, RAM, disk I/O, or bandwidth in a manner that degrades service for others
  • Attempt to evade suspensions, limits, or enforcement actions

We reserve the right to investigate, suspend, throttle, restrict, or terminate any service or account immediately, with or without notice, where necessary to:

  • Protect network integrity or stability
  • Prevent abuse, fraud, or security risks
  • Comply with legal or regulatory obligations
  • Protect other customers or third parties

5. Refund Policy

5.1 Game Servers & Bot Servers

  • A 72-hour refund window applies from the time of initial purchase.
  • Refunds requested within this window will be honored unless abuse or misuse is detected.
  • Refunds are not available after the 72-hour period.

5.2 Dedicated Machines

  • All dedicated machines are non-refundable once provisioned.
  • This includes setup fees, configuration fees, and partial billing periods.

5.3 Refund Exclusions

Refunds will not be granted for:

  • Violations of these Terms
  • Abuse-related suspensions or terminations
  • Chargebacks or payment disputes
  • Services that have been materially used

6. Chargebacks & Payment Disputes

You agree not to initiate chargebacks or payment disputes without first contacting support.

Any chargeback or dispute will result in immediate termination of all services, forfeiture of data, and permanent account closure. We reserve the right to recover all associated fees, damages, and administrative costs.


7. Billing & Renewals

  • Services are billed on a recurring basis unless otherwise stated.
  • Failure to pay invoices on time may result in suspension or termination.
  • Terminated services may have all data permanently deleted without recovery.

Late Fees (Game Servers & Bot Servers Only)

Invoices for Game Server and Bot Server services that remain unpaid five (5) days after the stated due date may be subject to a one-time late fee equal to ten percent (10%) of the overdue invoice amount.

  • Late fees are assessed once per invoice and do not accrue daily
  • Late fees do not apply to Dedicated Machines
  • Continued non-payment may result in service suspension, termination, or cancellation in accordance with these Terms

Notification emails are provided as a courtesy and are not guaranteed.


8. Data, Backups & Liability

You are solely responsible for maintaining current, off-site backups of all data.

Backups, snapshots, or recovery tools (if offered) are provided as a convenience only and are not guaranteed to:

  • Exist for any specific duration
  • Be complete, current, or restorable
  • Successfully recover all data

We are not liable for data loss, corruption, deletion, misconfiguration, downtime, or service interruption, regardless of cause, including user actions, software issues, upstream providers, or force majeure events.


9. Suspension, Termination & Associated Accounts

We may suspend or terminate any service or account immediately, without notice, for:

  • Violations of these Terms or any applicable policies
  • Abuse, fraud, security risks, or prohibited activity
  • Non-payment, chargebacks, or payment disputes

Associated / Linked Accounts

We reserve the right to identify and manage multiple accounts that we reasonably determine to be related through common ownership, control, payment methods, devices, networks, or behavior ("Associated Accounts").

If one account violates these Terms, we may:

  • Suspend or terminate any or all Associated Accounts
  • Deny future service or re-registration
  • Refuse refunds across all Associated Accounts

Creating additional accounts to evade enforcement actions is strictly prohibited.

Terminated accounts are not entitled to refunds.


10. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount paid for the affected service during the 30 days preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless GameServersHub LLC from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.


12. Arbitration Agreement (Mandatory)

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively through binding arbitration, conducted in accordance with the rules of the American Arbitration Association.

  • Arbitration shall take place in New Jersey, USA.
  • You waive the right to participate in class actions or jury trials.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict-of-law principles.


14. Changes to These Terms

We may modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the updated Terms.


15. Force Majeure

We are not liable for failure or delay in performance resulting from events beyond our reasonable control, including but not limited to natural disasters, power failures, network outages, upstream provider failures, labor disputes, governmental actions, or acts of God.


16. Severability

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force.


17. DMCA & Content Takedowns

We comply with the Digital Millennium Copyright Act (DMCA). If we receive a valid takedown notice or determine that content violates intellectual property rights, we may remove or disable access to such content without notice.

Repeat infringers may have their services or accounts terminated.


18. Service-Specific Responsibilities

Game Servers

  • Performance depends on configuration, mods, plugins, and player load
  • We do not guarantee compatibility with third-party mods or plugins
  • You are responsible for server configuration, content, and compliance with game EULAs

Discord Bots, APIs & SaaS Services

  • Services may be rate-limited, modified, or discontinued
  • Uptime is provided on a best-effort basis
  • We are not responsible for outages caused by Discord, third-party APIs, or platform changes

VPS & Dedicated Machines (General)

  • You are responsible for system security, updates, software licensing, and backups
  • Dedicated machines are unmanaged by default unless a Fully Managed service is explicitly purchased
  • We do not guarantee compatibility with customer-installed software, operating systems, or configurations

Fully Managed Dedicated Machines (If Purchased)

Where a Fully Managed service is offered and explicitly purchased, GameServersHub will provide management assistance limited to the scope of services we support at the time the service is rendered.

Fully Managed services are provided on a best-effort basis and are subject to the following conditions:

What Fully Managed Includes
  • Initial operating system provisioning (supported Linux distributions only)
  • Basic system hardening and security configuration
  • Assistance with supported control panels or services offered by GameServersHub
  • Troubleshooting of issues directly related to the underlying server environment
  • Basic service monitoring and operational guidance
What Fully Managed Does NOT Include
  • Support for Windows-based dedicated machines (Windows servers are not eligible for Fully Managed services)
  • Custom application development or scripting
  • Support for unsupported, experimental, or third-party software not offered or endorsed by GameServersHub
  • Game mod/plugin debugging, optimization, or conflict resolution
  • Ongoing application-level administration or content management
  • Performance guarantees beyond hardware replacement obligations
  • Responsibility for customer data, backups, or licensing compliance
Scope Limitations
  • Fully Managed services are limited by GameServersHub’s internal expertise, tooling, and service offerings at the time support is requested
  • Support capabilities may change over time and are not guaranteed to expand or remain available indefinitely
  • Requests outside the supported scope may be declined at our discretion

Dedicated machines that are not explicitly designated as Fully Managed remain fully unmanaged, and all administrative responsibility rests with the customer.


19. Data Deletion

Upon suspension or termination:

  • Data may be deleted immediately or within a reasonable period
  • We do not guarantee retention or recovery of terminated services

20. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific rules, constitute the entire agreement between you and GameServersHub LLC.
